An Upper Area Court in Zuba, FCT, on Thursday restrained the police from re-arresting and detaining a taxi driver, Ibrahim Umar over allegation of causing hurt.
Mr Gambo Garba, the Presiding Upper Area Court Judge gave the order during the hearing of the case file by the Police against Umar.
The Prosecution Counsel, Mr Chinedu Ogada appeal to the court that the police wants to terminate the charges against the suspect on the grounds that there was no proper investigation into the matter.
Ogada relies on Section 108 of the Administration of Criminal Justice Act (ACJA).
According to him, the Nominal Complainant reported the matter to the Police Area Command, Life Camp, Abuja that the matter was not properly investigated.
“The termination was to enable the police conduct proper investigation into the matter.
In his ruling, Garba, refused the application and adjourned the matter to enable the police conduct proper investigation.
He ordered the defendant to honour police invitation for investigations adding that the police should not arrest or detain the defendant on matters relating to the allegations against him without the consent of the court.
News Agency of Nigeria recalls that the suspect was arraigned on Oct. 11 on allegation of causing hurt contrary to section 240 of the Penal Code.
On Oct. 10 one Dr Busola Akintayo of Arab Road Kubwa, Abuja reported at Gwarinpa Police Station that she entered the Volkswagen car belonging to the suspect at Gwarinpa junction.
The Car has registration number AE 446 DMA.
She alleged that on their way from Gwarimpa to Kubwa, the complainant brought out N200 note expecting to be given N100 change.
She alleged that the driver acted in a violent manner, beat her up she sustained injuries and lost some of her valuables worth N452, 000.
She said that she also hospitalised at the Federal Staff Hospital Gwarimpa as a result of the beating.
